It is understandable, then, that Cardozo did not reject transferred intent out of hand or admit the incompatibility of transferred intent’s normative logic with his opinion’s grand claims about the nature of tort liability.134 Doing so would have severely compromised the interpretive and moral plausibility of those claims and weakened the persuasive power of his judgment. Instead, he acknowledged the doctrine and intimated that its significance lies outside the domain of his discussion, in two passages.
